Task Forces and Consortia Management

In line with legal provisions, such as under the Biocidal Products Regulation No 528/2012 (EU BPR) and Plant Protection Regulation No 1107/2009, interested companies can share the costs for product studies, dossier preparation and authorisation fees by forming consortia or task forces for the authorisation or registration of their active substances or products.

From the start, we have been involved in more than 30 task forces and consortia, ranging from two to several dozens of member companies.

With continuously increasing complexity of regulatory requirements and scientific and legal issues getting more and more interlocked and interdependent, SCC Legal logo was founded as an independent spin-off of SCC in 2019. Only Representative Services in Key Chemicals Markets

Importers can either carry out registration procedures for the goods they are placing in target markets or appoint a representative based in these markets who is to take over the tasks and responsibilities of importers for complying with all regulations. Appointing a representative can simplify market access, secure the supply chain and reduce the responsibilities for importers. This option is provided in a number of chemicals regulations across the world.

We offer representative services for the chemicals markets of the European Union, United Kingdom, South Korea, and Turkey.

We are a member of  ORO logothe Only Representative Organisation (ORO) – representing the majority of Only Representative service providers in Europe. Our experts have the experience and expertise to take over the OR role for non-EU chemical companies. We are physically established in the EEA and are skilled in the practical handling of substances and the information related to them under REACH. We have provided complex supply-chain and OR support to numerous overseas clients since the start of REACH.

Trustee Function under EU REACH

REACH requires non-EU manufacturers and importers of the same substance to closely work together in order to determine the total imported substance volume (tonnage per registrant) and all industrial, professional, and consumer uses of the substance for the EU market. While trying to meet this requirement, companies often risk violating the EU competition law. As independent party, we can act as a trustee, enabling companies to share legally required information in a legally compliant manner between the concerned stakeholders, all the way up and down the supply chain.

With our long-standing experience and established reputation as an independent partner (e.g. consortia leader), we are able to create the right balance of discretion and transparency. We always seek robust compliance, while handling delicate trustee mandates to all parties’ fullest satisfaction.

 

Joint Submission Management

Joint submission (JS) groups represent co-registrants intending to submit a joint registration for the same substance. These groups are formed to facilitate data sharing between the companies and avoid duplication of testing.

After the end of the phase-in period with the registration deadline in May 2018, co-registrants are  encouraged to use joint submission or similar informal communication platforms enabling them to meet their running registration and data sharing obligations under REACH. SCC provides complete joint submission management, covering all technical, scientific and regulatory aspects.

As lead registrant you may need to lead and run a joint submission group, but might lack the resources or experience to do so well. We are skilled in efficiently managing registration groups and consortia on behalf of our customers and have enjoyed high industry trust for many years.
